Customer - (1) a natural person with full legal capacity; (2) a legal person; or (3) an organizational unit lacking legal personality, which is recognized under the law as having legal capacity; - who or that has concluded or intends to conclude a Sales Agreement with the Seller.

Service Recipient - (1) a natural person with full legal capacity; (2) a legal person; or (3) an organizational unit lacking legal personality, which is recognized under the law as having legal capacity; - who or that has concluded or intends to conclude a Sales Agreement with the Seller.

Online Shop - the Service Provider’s Online Shop www.swingfashion.pl

1. GENERAL PROVISIONS

1. This Privacy Policy contains information regarding the personal data protection methods of Service Recipients/Customers of the Online Shop at the internet address www.swingfashion.pl

2. The Administrator of the personal data collected through the Online Shop is Katarzyna Rupińska, who conducts business as SWING KATARZYNA RUPIŃSKA (business address: ul. Przemysłowa 24, 18-305 Szumowo, shop@swingfashion.pl, tax identification number (NIP): 7231608395, REGON: 200878423). This enterprise is entered in the Central Registration and Information on Business.

3. Personal data of the Service Recipients/Customers are processed in accordance with the Personal Data Protection Act (Journal of Laws 1997, No 133, pos.883, as amended) and the Act on the Rendering of Electronic Services (Journal of Laws 2002, No 144, pos.1204, as amended).

2. PURPOSE, EXTENT AND RULES OF PERSONAL DATA COLLECTION

1. The Administrator processes the Service Recipient and Customer’s personal data for the purpose and in the extent necessary for the Service Recipients/Customers to use the Online Shop, in particular, to enable purchases through the Online Shop and the registration of the Account.

2. Possible purposes of collecting personal data of the Service Recipients/Customers by the Administrator:

a) conclusion and execution of the Sales Agreement or contract for providing Electronic Services;

b) direct marketing of own products or services of the Administrator.

3. Possible recipients of personal data of the Online Shop Customers:

a) in case of the Customer who chose courier shipment as a method of delivery, the Administrator provides the collected personal data of the Customer with the courier company;

b) in case of the Customer who chose a payment by a bank transfer, by credit card or electronic payments as a method of payment, the Administrator provides the collected personal data of the Customer with the entity providing above-mentioned payments in the Online Shop.

4. The Administrator may process the following Customer’s personal data: full name, telephone number, e-mail address, delivery address (street, house number, postcode, city, country), address of residence/business address (only if it is different form delivery address). In case of Customers who are not consumers, the Administrator may also process the company name and tax identification number (NIP).

5. Providing any personal data by the Service Recipients/Customers is voluntary. Providing the personal data specified in 2.4 is necessary for the conclusion of the Sales Agreement with the Seller upon terms and condition specified in the Terms and Conditions of the Online Shop.

6. Providing personal data may be necessary for the conclusion and execution of the Electronic Service Agreement. Each time the extent of data required for the conclusion of the agreement is indicated beforehand on the website of the Online Shop.

3. SERVICE RECIPIENT/CUSTOMER RIGHTS

1. The Service Recipient/Customer has the right to view and edit the content of his or her data, to correct, change or delete such data from the Administrator’s database. In order to exercise this right, the Service Recipient/Customer must send the Administrator an e-mail with a relevant request, using the Service Recipient’s/Customer’s e-mail address indicated in the Registration Form at shop@swingfashion.pl.

2. The Service Recipient is also entitled to withdraw his or her previously granted consent to have his or her personal data processed for marketing purposes (Newsletter). To withdraw such consent, the Service Recipient must send an appropriate message at shop@swingfashion.pl.

4. COOKIE FILES

1. The Online Shop uses cookies to gather information connected with the Service Recipient’s/Customer’s visit in the Online Shop. During the Service Recipient’s/Customer’s visit may be automatically collected information such as IP address, an operating system, a browser Service Recipient’s/Customer’s ID.

2. Cookies are IT data, in particular small text files, saved and stored on the Service Recipient’s/Customer’s devices which enable:

1) keep the Service Recipient/Customer logged in, and, as a result he or she is not required to re-enter the login and password on every subsite;

2) adapt and optimize the Online Shop to the Service Recipient’s/Customer’s needs;

3) create the Online Shop’s subsite traffic statistics;

4) personalise marketing communications;

5) ensure the security and reliability of the Online Shop’s operation.

3. The Online Shop uses session cookies, which are deleted once the browser window is closed, as well as persistent cookies, saved on the Service Recipient’s/Customer devices which remain there for the time specified in the cookie parameters or until being manually deleted in the browser.

4.Google Analytics uses cookies in order to allow analysis by the Online Shop of traffic sources and the way in which visitors use it. Google collects data on its servers obtained from the placement of cookies on devices and uses this information to create reports and provide other services relating to use of the Internet. Google may also transfer this information to third parties where required to do so by law, or in the case where such third parties process the information on Google’s behalf. Service Recipient/Customer may block the data collected by cookies relating to visit in the Online Shop (including IP address) and sending them to Google by downloading and installing the plugin available at the address: https://tools.google.com/dlpage/gaoptout?hl=pl.

5. Google AdWords uses cookies in order to allow the Online Shop to assess the correctness and effectiveness of their advertising activities using the AdWords network. Google collects data on its servers obtained from the placement of cookies on devices and uses this information to create reports and provide other services relating to use of the Internet. Google may also transfer this information to third parties where required to do so by law, or in the case where such third parties process the information on Google’s behalf.

6. In cookies are not stored any Service Recipient’s/Customer’s personal data. Cookies are not used to determine the Service Recipient’s/Customer’s identity.

7. Cookies are used in the Online Shop with the Service Recipient’s/Customer’s consent.

8. Service Recipient/Customer may limit or disable cookies in the browser by modifying browser settings:

9. Limiting cookies may make impossible the correct use of the Online Shop.

5. SECURITY

1. The Administrator uses technical and organizational measures to protect the processed personal data applicable to the threats and categories of data subject to protection, and, in particular it protects data against its unauthorized access, unauthorized retrieval, processing in violation of applicable laws, loss damage or destruction.

2. The Administrator provides the following technical measures to prevent unauthorized retrieval and modification of personal data sent electronically:

1) encrypting data used for Service Recipient’s/Customer’s authorization;

2) SSL certificate on the Online Shop website where Customer’s data is provided;

3) protecting the data set from unauthorized access;

4) access to the Account only after providing an individual login and password.

6. FINAL PROVISIONS

1. The Online Shop may contain links to other websites. The Administrator recommends acquainting with the privacy policy stated there. This Privacy Policy applies only to this Online Shop.

2. The Administrator reserves the right to amend the Privacy Policy in the future, this may occur for the important reasons, in particular:

1) changes in applicable laws, in particular regarding the protection of personal data and providing electronic services;

2) changes in the conditions of technological functioning of the Online Shop.
